You have worked all your life, with an eye towards spending time doing things you enjoy with the people you love during your retirement. Unfortunately, when problems arise in your retirement benefits, it can put those activities on hold, while threatening your financial security.

With our legal knowledge and experience in these matters, we can advise you on the best course of action to get the benefits you are entitled to.

Filing A Claim For Retirement Plan Benefits

One of the first things to do when filing a retirement benefit claim is to get a copy of your summary benefit plan, which outlines your benefits, as well as the rules and requirements of your plan. Unfortunately, simply meeting these requirements, such as working a certain number of years or reaching a certain age, is no guarantee your benefits will be approved. According to the  U.S. Department of Labor (DOL) all filed claims must go through the following process:

  • Claim review: Once filed, your claim may take between 90 to 180 days to review;
  • Claim appeal: If your claim is denied, you have up to 60 days to appeal the decision, providing any additional information or documents required to support your claim.
  • Review of appeal: Another 60-120 days are allowed for your appeal to being considered;
  • Denial of appeal: If your appeal is denied, you will be notified in writing as to reason why, and the rules governing this decision.

Help For When Your Retirement Benefit Claim Is Denied

The Employee Retirement Income Security Act of 1974 (ERISA) is a federal law protecting your rights to appeal when your retirement benefits claim is denied, while providing standards in terms of how your benefits are managed and administered by your plan. While ERISA allows claimants the right to sue when retirement benefits have been denied and to hold plan administrators accountable for breach of their duties, the applicant must first follow all claims appeal filing procedures before a lawsuit can be brought.
