Roberts Disability Law, P.C. recently announced the filing of a lawsuit against Unum Life Insurance Company of America on behalf of a former Valero refinery operator who alleges that Unum improperly reduced and underpaid his long-term disability benefits. According to the lawsuit, the plaintiff worked as a refinery operator for Valero until disabling medical conditions prevented him from continuing his employment. After he became disabled, Unum approved his claim for long-term disability benefits. The complaint alleges that Unum subsequently applied offsets and reductions that resulted in the plaintiff receiving less than the amount of benefits owed under the terms of the policy.
The lawsuit contends that Unum’s calculation of benefits violated the governing disability plan and improperly reduced income intended to protect the plaintiff after he became unable to work.
The action seeks recovery of unpaid long-term disability benefits allegedly due under the Employee Retirement Income Security Act of 1974 (“ERISA”), together with any other relief available under the law.
